10. Responsibilities

10.1. It is the user's responsibility:

a) defects or technical flaws originating from the user's own system;

b) the proper use of the platform, services, or products offered, ensuring good coexistence, respect, and cordiality among users;

c) compliance with the set of rules outlined in this General Terms of Use, in the respective Privacy Policy, and in the legislation;

10.2. The User may not engage in the following actions with respect to the Site, in whole or in part, without prejudice to others that may be considered illegal, contrary to public order, or against morality and good customs:

i) engaging in any illegal acts and/or violations of current legislation, including the provisions of Law 9.613/98 and Law 12.846/13;

ii) Using the Site and/or any content contained therein, in whole or in part, by any means or form, for purposes different from those for which it is intended and in a manner different from that provided in this TERM, including disclosing, for any reason, to third parties who do not have or should not have access to the Site;

iii) Deleting, distorting, corrupting, altering, editing, adapting, transmitting, or in any way modifying, by any means or form, in whole or in part, the Site, and/or any content contained therein;

iv) Advertising or marketing by associating its image with ECOMENERGIA or any affiliated, controlled, associated company, or belonging to its economic group, for any disclosure of the data contained in this site, as well as its brands;

v) Uploading, sending, and/or transmitting any content of an erotic, pornographic, obscene, defamatory, or slanderous nature or that advocates crime, drug use, consumption of alcoholic beverages or smoking products, physical or moral violence;

vi) Uploading, sending, and/or transmitting any content that promotes or incites prejudice (including origin, race, sex, color, sexual orientation, and age) or any form of discrimination, as well as hate or illegal activities;

vii) Threatening, coercing, or causing physical or moral embarrassment to other Users;

viii) Engaging in acts that cause or may cause contamination or harm to any equipment, including through viruses, trojans, malware, worms, bots, backdoors, spyware, rootkits, or any other devices that may be created;

ix) Engaging in any acts relating to the Site, directly or indirectly, in whole or in part, that may cause harm to ECOM ENERGIA, any User, and/or any third parties;

ix) Using any business name, trademark, domain name, slogan, or promotional expression or any distinctive sign or intellectual property owned by ECOM ENERGIA or any affiliated, controlled, associated company, or belonging to its economic group.

10.3. The User is exclusively responsible:

i) For all and any acts or omissions performed by him/her in the Site environment;

ii) For the repair of all and any damages, direct or indirect, caused to ECOM ENERGIA, any other User, or any third party, including due to non-compliance with the provisions of this TERM. Without prejudice to other measures, ECOM ENERGIA may, at any time, at its sole discretion, without the need for any prior notice or notification, suspend access to the Site and/or Application of any User, at any time, if it violates any provision of this TERM and other site policies or applicable legislation.

10.4. Under no circumstances will ECOM ENERGIA be responsible:

i) For the payment of costs or damages, including direct, indirect, specific, incidental, or consequential damages, resulting from access to or use, impossibility of access to or use of this Site or any of its functions or parts, including for the purpose of consulting or downloading information, data, texts, images, or other materials accessible through this Site;

ii) For any act or omission performed and/or damage caused by the User on this Site;

iii) For the installation on the equipment of the User or third parties, of viruses, trojans, malware, worms, bots, backdoors, spyware, rootkits, or any other devices that may be created, as a result of the User's navigation on the Internet.

iv) For the improper use by any user or third parties of the Site, in whole or in part, by any means or form, including, but not limited to, reproduction and/or disclosure in any means;

v) for any direct, indirect, incidental, exceptional, or resulting damage from the use or inability to enjoy its services, or for the cost of acquiring substitute services.

10.5. It is the responsibility of the platform ecomenergia.com.br:

a) to indicate the characteristics of the service or product;

b) the defects and flaws found in the service or product offered provided that it was caused by it;

c) the information that has been disclosed by it, noting that the comments or information disclosed by users are entirely the responsibility of the users themselves;

d) the illicit content or activities practiced through its platform.

The platform is not responsible for external links contained in its system that may redirect the user to an external environment outside its network.

No external links or pages serving commercial or advertising purposes or any illegal, violent, controversial, pornographic, xenophobic, discriminatory, or offensive information may be included.
